Section 4 of the twenty-fifth Amendment to The Constitution of The United States states;
Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
Essentially, what this means is if the President suddenly loses his mind and starts saying things like,
"Gentlemen, in my poker game last night, President Truman told me to nuke Pakistan and his advice was seconded by President Grant.....so get me "the football" and lets get this done."
The Vice President and the rest of the cabinet can declare the President nuts and remove him from office.
Today, in Charlotte, North Carolina CEO of Bank of America Ken Lewis made these statements;
- Countrywide and Merrill Lynch have been "stars" this year.
- Merrill "Will be a thing of beauty over the long term."
- “Everything we thought is playing out” with regard to the Merrill purchase.
If BofA has ANYTHING remotely resembling our constitution's twenty-fifth amendment they should use it immediately because CEO Lewis has lost his mind! And here is the proof!
